1. Acceptance of Terms

By accessing or using CrowAbout ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

CrowAbout is a review request platform that enables UK businesses to send SMS messages to their customers requesting reviews on platforms like Google and Facebook. The Service includes:

  • SMS review request delivery
  • Custom review landing pages
  • QR code generation for printed materials (leaflets, business cards, etc.)
  • Call tracker with screenshot import for managing missed calls and follow-ups
  • Analytics and click tracking
  • Subscription management

3. User Accounts

To use the Service, you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

4. Acceptable Use

You agree NOT to:

  • Send SMS messages to individuals who have not consented to receive them
  • Use the Service for spam or unsolicited marketing
  • Send messages containing illegal, harmful, or offensive content
  • Impersonate any person or entity
  • Attempt to manipulate or fake reviews
  • Use the Call Tracker to harass or repeatedly contact individuals who have requested not to be contacted
  • Upload screenshots or content that contains malicious data
  • Violate any applicable laws or regulations (including GDPR and PECR)
  • Interfere with or disrupt the Service
  • Resell or redistribute the Service without permission

5. SMS Consent Requirements

By using the Service, you confirm that you have obtained proper consent from your customers to contact them via SMS. You are solely responsible for compliance with UK regulations including:

  • Privacy and Electronic Communications Regulations (PECR)
  • General Data Protection Regulation (UK GDPR)
  • Data Protection Act 2018

6. Subscriptions and Payments

Paid subscriptions are billed monthly. By subscribing, you authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time through the billing portal. Cancellations take effect at the end of the current billing period.

SMS allowances reset monthly. Unused SMS credits do not roll over to the next month. QR code limits and call tracker entry limits are determined by your subscription tier.

7. Refunds

We offer refunds on a case-by-case basis. If you believe you are entitled to a refund, please contact us at [email protected] within 14 days of the charge.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. SMS delivery depends on third-party carriers and is subject to their availability. We are not liable for delays or failures in SMS delivery.

9. Intellectual Property

The Service, including its design, features, and content, is owned by CrowAbout. You may not copy, modify, or distribute any part of the Service without our permission.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CROWABOUT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless CrowAbout from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may terminate your account at any time by contacting support.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms.
